5. RSS Newsfeed provision
5.1 Lew's Computers provides a Really Simple Syndication (RSS) newsfeed (now termed 'RSS newsfeed' or 'newsfeed' from this moment henceforth) per se purely for informational purposes.
5.2 Lew's Computers permits the content of its RSS newsfeed to be received by and broadcast by a compatible and validly constructed news reading software program. Such content must be utilised for personal purposes only.
5.2.1 You accept that the content of the newsfeed remains exclusively under control of Lew's Computers.
5.2.2 Lew's Computers will not be liable for any misfortune(s) that may arise out of the access, reception and broadcast of content from the newsfeed via your own computer.
5.3 Lew's Computers permits the content of its RSS newsfeed to be received by and broadcast by a compatible and validly constructed news reading component on an external website, provided that the following sub-clauses are met:
5.3.1 Any title, ownership and/or intellectual rights within the content of the newsfeed remain the property/properties of either Lew's Computers and/or the relevant person/organisation.
5.3.2 You must correctly acknowledge Lew's Computers as the original provider of the content of the newsfeed.
5.3.2.1 You must not use the Lew's Computers logo, motif or slogan in any acknowledgement.
5.3.2.2 The following are acceptable and approved acknowledgements. You must not use any other form of acknowledgement whether in text or graphic form.

5.3.2.3 Please refrain from acknowledging specific areas, sections or minisites of Lew's Computers Online, e.g. 'Collaboration', 'Reality TV', 'The X Factor Access'.

(a). Websites of a pornographic or adult-content oriented nature;
(b). Websites that deliberately mislead or have defamatory content or promote and/or support illegal activity;
(c). Websites that promote and/or support violent behaviour;
(d). Websites that promote and/or support terrorist activity;
(e). Websites that promote and incite hatred and discriminatory behaviour in relation to race, gender, religion, sexuality, and social norms;
5.3.4 No charge must be issued by your website for accessing and receiving the newsfeed content via your website.
5.3.5 No attempt on your part must be made to amend, disassemble or alter in any other way the content of the newsfeed. No inhibition or restriction of access back to Lew's Computers Online must be attempted, unless unavoidable, whereby you should provide alternative and appropriate link(s) back to Lew's Computers Online relevantly pertaining to the newsfeed content.
5.3.6 Lew's Computers does not endorse nor promote your website as a result of the transmission of the newsfeed content to your website. No attempt on your part must be made to suggest otherwise.
5.3.7 The newsfeed content and its use by your own website's end-users must be excluded from your own website's terms of use.
5.3.8 You accept that the content of the newsfeed remains exclusively under control of Lew's Computers.
5.3.9 Lew's Computers will not be liable for any misfortune(s) that may arise out of the access, reception and broadcast of content from the newsfeed via your website.
5.4 Lew's Computers is not endorsed and/or promoted and/or approved by any person and/or organisation that may be referred to within the content of the newsfeed.
5.5 Lew's Computers reserve the right to terminate at anytime the RSS newsfeed service without advanced warning, and without informing you and any other relevant party thereafter the termination.
5.6 If you do not accept any part or all of clause 5, you must remove, destroy and refrain from further use of newsfeed content from Lew's Computers Online on your computer/at your website.

6. Computer software downloaded from Lew's Computers Online
6.1 A 'download' for the purposes of these Terms of Use is a piece of computer software, either developed in whole (or partly) by Lew's Computers or another third party manufacturer, that has been obtained DIRECTLY from Lew's Computers Online.
6.2 The title, ownership and/or intellectual rights relating to the download remain the property/properties of either Lew's Computers and/or their rightful owners.
6.3 In direct reference to downloads developed in whole or in part by Lew's Computers, you may not copy, reproduce, republish , broadcast, transmit, disassemble or deliver or amend in any other way the download, unless granted appropriate permissions by Lew's Computers (and if necessary, another relevant third party manufacturer). For all other downloads you must respect the copyright imposed on the download.
6.4 You utilise any download at your own risk.
6.5 Lew's Computers are not responsible for any misfortune(s) that may arise out of the utilisation of any download obtained directly from Lew's Computers, or suggested, to be acquired indirectly from another source.
6.6 While every attempt is made to scan download components for computer viruses and/or other malicious elements, you have the responsibility to ensure that your computer has sufficient and appropriate protection against such threats. Lew's Computers will not be held responsible (as declared initially in subclause 6.5) for any misfortune, specifically data loss, interruption to business operations, loss profit, arising out of utilisation of the download.
6.7 You have the responsibility to ensure that your computer has met the technical requirements to execute and process any available download. Lew's Computers will not be held responsible for failure, restriction of operation or other technical problems that may result from attempting to utilise the download on your computer. Lew's Computers, unless otherwise suggested, will not provide any form of support or warranty with relation to any available download.

7. Input provided by you, the end-user
7.1 A 'channel' for the purposes of these Terms of Use is a method of providing your input to Lew's Computers, e.g. online forms, forums, weblogs, that has been approved and is declared currently available for use at Lew's Computers Online, or is recommended by Lew's Computers.
7.2 Lew's Computers reserve the right to alter, suspend or discontinue any channel at any time without advanced warning.
7.3 Lew's Computers welcomes any input that you may wish to confer but such communication should be made through the appropriate and available channels provided at Lew's Computers Online. Lew's Computers will not always receive your input through an inappropriate, suspended or discontinued channel.
7.4 Lew's Computers does not anticipate receiving any information from you that is confidential and/or proprietary EXCEPT where we explicitly request for such information, in which case you will always be aware of this beforehand. Thus, all information that you may provide us that both you and Lew's Computers acknowledge as non-confidential and/or non-proprietary mayl be treated as such. 7.5 Lew's Computers will always treat all information that you provide us that both you and Lew's Computers acknowledges is confidential and/or proprietary. Lew's Computers will always explicitly request for such information. Any information that you may provide Lew's Computers where no explicit request for such confidential and/or proprietary data is made may be treated as if non-confidential and/or non-proprietary (as declared initially in subclause 7.2). Lew's Computers ensures that confidential and/or proprietary data received by the organisation is utilised for the appropriate purposes and in accordance for the intention that you have acknowledged, stored safely, securely and sensibly, and that such data is not utilised and stored for longer than is necessary unto which time the data is properly destroyed. Furthermore, such confidential and/or proprietary data is not divulged to third parties without your authorisation, by Lew's Computers. Please consult the Privacy Policy for Lew's Computers Online for information pertaining to how Lew's Computers utilises and stores data that may be provided to the organisation.
7.6 Lew's Computers does not accept the transmission of any information via Lew's Computers by you, that may be threatening, illegitimate, libellous, obscene, defamatory, pornographic, or promoting and/or supporting violent, anti-social and/or terrorist activity, or that incites hatred with relation to race, gender, religion and sexuality, through any available channel at Lew's Computers Online.
7.7 Lew's Computers reserve the right to use non-confidential and/or non-proprietary information that may be provided to the organisation in accordance with the intention that you acknowledged prior to providing such information and in accordance with the Lew's Computers Online Privacy Policy.
7.8 Lew's Computers reserve the right to refuse to reply to and/or follow-up any input that may be provided by you, on reasonable grounds.

8. Chat rooms, Forums, Guest books and/or Weblogs
8.1 Lew's Computers may from time-to-time make available chat room, forum, guest book or weblog facilities to you, at specific areas, sections or minisites of Lew's Computers Online.
8.2 Such facilities may be provided in conjunction with a third party by another third party, and be administered by that third party.
8.2.1 Any terms and conditions of use that may be expressed by the third party, for the chat room, forum, guest book or weblog will supersede subclauses 8.3 - 8.6 and their subclauses, of these Terms of Use, unless otherwise stated, and must be understood and accepted by you before you use such facilities.
8.3 By use of a chat room, forum, guest book or weblog you agree to ALL of the following subclauses:
8.3.1 That you will not post any material in text, graphic or other form that is false, inaccurate, defamatory, obscene, profane, vulgar, harassing, incites hatred, is threatening, is sexually-oriented or pornographic in nature, invades another end-user's privacy or is illegitimate.
8.3.2 That you will not post any material that is not under your own copyright, unless you have obtained appropriate permission from the rightful copyright holder. You must always respect the copyright of the rightful owners and understand that the title, ownership and intellectual rights of any material remains the property of the rightful owner. Lew's Computers reserve the right to request for proof of copyright or permission of the copyright holder.
8.3.3 The following uses of the facilities aforementioned are inappropriate and prohibited:
(a). Spam
(b). Advertisements - commercial and non-commercial
(c). Message flooding
(d). Chain mail/messages
(e). Pyramid schemes
(f). Solicitations
If you are found to be responsible for posting any of the above your registration account (if applicable) and/or access to Lew's Computers Online and/or the facilities aforementioned are/is subject to temporary/permanent suspension.
8.3.4 Lew's Computers reserve the right to monitor at its discretion activity at the aforementioned facilities. Lew's Computers reserve the right to amend or remove posted messages in the interests of all end-users. Lew's Computers reserve the right at anytime to temporarily or permanently suspend the registration account and/or access to Lew's Computers Online and/or the facilities aforementioned, of yourself, should you be in breach of any applicable clause(s) of the Terms of Use.
8.3.5 Lew's Computers cannot always actively monitor all activity at the aforementioned facilities, and therefore cannot verify the accuracy, appropriateness, validity and relevance of any posted messages at all times. Lew's Computers does therefore encourage you and any other end-user to report any abuse of the aforementioned facilities and/or breach of any clause(s) of the Terms of Use through their use. Such reports are treated with confidentiality.
8.3.5.1 Please allow Lew's Computers time to take any necessary action in response to any report of abuse you may make.
8.3.6 Any message posted at the aforementioned facilities does not necessarily reflect the views and opinions of Lew's Computers. No message is necessarily endorsed nor approved by Lew's Computers.
8.3.7 You take complete responsibility for the entire content of any message you should post at the aforementioned facilities, including any file attachments. Lew's Computers cannot be held responsible for any misfortune(s) or harm that may result from any posted message and/or file attachment.
8.3.7.1 Lew's Computers does regard your privacy of utmost importance in the use of the aforementioned facilities - consult the Privacy Policy for Lew's Computers Online - but in the extenuating circumstance that a complaint or legal action results in Lew's Computers having to reveal your identity this will have to be performed.
8.3.8 Where registration is a feature of any of the aforementioned facilities, you will be encouraged but not obliged to register your basic (but not personally identifiable) details. 8.3.8.4 Any end-user in breach of subclauses 8.3.8.1, 8.3.8.2 and 8.3.8.3 may be subject to a temporary or permanent suspension of their registration account and/or access to Lew's Computers Online and/or the facilities aforementioned.
8.3.9 Lew's Computers and/or a third party, dependent on how the aforementioned facilities are provided to you, reserve the right to record the IP address associated with your access and will use this information to suspend you and/or inform your Internet Service Provider (ISP) if necessary in the event of a breach of the applicable clause(s) of the Terms of Use. In accordance with the Privacy Policy for Lew's Computers Online, no personally identifiable information is acquired during this process.
8.4 Lew's Computers reserve the right to temporarily and/or permanently suspend any chat room, forum, guest book, or weblog at anytime without advanced warning. Any material present at these facilities may be subject to temporary and/or permanent deletion.
8.5 Lew's Computers makes no backup of material that may be present at any chat room, forum, guest book, or weblog.
8.6 You are reminded to be responsible for any action you exercise at any chat room, forum, guest book, or weblog and to respect other end-users. Due to the precarious nature of the Internet, you are reminded to take care, use common sense and if necessary communicate your intentions to people you know before exercising any actions. 9. Fanlists
9.1 Inclusion on any fanlist is subject to you providing all of the sufficient information requested for at registration. In accordance with the Privacy Policy for Lew's Computers Online, no personally identifiable information is collected. The significant exception to this rule is detailed in subclause 9.2
9.2 You may be asked for your e-mail address at registration for a fanlist. You are reminded that this is optional and are under no obligation to submit such information, in accordance with the Privacy Policy for Lew's Computers Online. The only purpose that you may submit this information is to enable other end-users to contact you. If submitting this information you agree to ALL of the following subclauses:
9.2.1 You acknowledge that your e-mail address is now publicly available.
9.2.2 Lew's Computers cannot be held responsible for any misfortune(s) that may arise out of the submission of your e-mail address for the above mentioned purposes, and of any reply/replies you may receive through this e-mail address, resultant of inclusion on the fanlist.
9.2.3 Lew's Computers cannot be held responsible for the validity, relevance and appropriateness of any e-mail address submitted and included on the fanlist. You are responsible for providing a valid, active, relevant and appropriate e-mail address.
9.2.4 Other end-users must always exercise caution and think carefully before replying to any e-mail address listed on the fanlist. Lew's Computers will not be held responsible for any misfortune(s) that may arise out of replying to any e-mail address listed on any fanlist.
9.2.5 Lew's Computers reserves the right to remove any e-mail address listed on the fanlist, and in accordance with the Privacy Policy for Lew's Computers Online will destroy such information.
9.2.6 In accordance with the Privacy Policy for Lew's Computers Online, the e-mail address you submit will not be divulged by any other means EXCEPT through the inclusion on the fanlist to any other third party.
9.3 Lew's Computers reserve the right to amend or remove the details of any end-user listed on the fanlist, at anytime, without advanced warning. In accordance with the Privacy Policy for Lew's Computers Online, all information on the fanlist and in association with the the fanlist, associated with the end-user in question will be destroyed.
9.4 Lew's Computers reserve the right to suspend or terminate any fanlist. In accordance with the Privacy Policy for Lew's Computers Online, all information on the fanlist and in association with the the fanlist will be destroyed.

10. Linking to Lew's Computers Online
10.1 Lew's Computers encourages linking from your own or another external website to any part of Lew's Computers Online, but by doing so you accept the following remaining subclauses under Clause 10.
10.2 Your link must be valid and be compliant with the following:

(b). Link to a valid URL at Lew's Computers Online.
(i). The EXCEPTION here is when you have previously linked to a valid URL that has now become obsolete.

12.4 By removing any link to Lew's Computers Online that you make available at an external website you terminate any binding to the Terms of Use, clause 10.
